AI Voice Bots and the TCPA
AI-generated and prerecorded voice calls count as robocalls under TCPA and FCC rules, so they need prior express written consent. Here is what that means for VICIdial.
An AI voice bot is software that talks to the person you call using a generated or synthetic voice instead of a live human. The FCC has made the rule plain: AI agents and voice bots fall under the same regulations as prerecorded audio calls. That means an AI-driven call is treated as a Robocall under the TCPA, and a marketing robocall to a cell phone needs prior Express written consent before you dial. The shiny new technology does not change the law; it just lands inside an existing one.
What this means for a VICIdial operator
If you wire an AI agent or a synthetic-voice script into your campaign, you are running prerecorded-style calls, full stop. So you need documented written consent for marketing, you need to scrub against the national do-not-call registry and your Internal DNC, and you need to respect calling hours just like any other automated campaign. Live agents using VICIdial in manual or human-handled modes are a different category; the moment a machine voice carries the message, the prerecorded rules attach. Treat your AI bot campaigns as the highest-risk thing on your account and gate them behind consent.
The same logic the FCC applied to ringless voicemail applies here: if it reaches a consumer with an automated message, permission is required. For how all of this fits your dialer setup see our VICIdial compliance overview, and read what express written consent is before you launch a single AI call.
Consent gate for AI calls
flowchart TD
A[Lead queued for AI voice campaign] --> B{Prior express written consent on file}
B -->|No| C[Do not place AI call]
B -->|Yes| D{Number on DNC or internal DNC}
D -->|Yes| C
D -->|No| E{Within permitted calling hours}
E -->|No| F[Hold until allowed time]
E -->|Yes| G[Place AI voice call as robocall]The gate makes the order clear: consent first, then DNC scrubbing, then calling hours, and only then does the AI bot dial. Skip any step and you are placing an unconsented robocall.
VICIfast gives you consent fields, DNC scrubbing, and calling-hour controls so an AI campaign cannot run ahead of permission. See pricing to set it up the right way.
