State telemarketing law overview
Which states have their own telemarketing rules on top of federal TCPA, and the operational deltas.

Common deltas across states
Tighter time windows
Some states tighten the 8am-9pm federal window. Florida (FTSA): 8am-8pm. Always use the called party's local time.
Registration / licensing
Several states require you (or your client) to register as a telemarketer before placing commercial calls:
- Indiana
- Pennsylvania
- Florida (per-product registration)
Annual fees + renewals.
Statutory damages > federal
Florida (FTSA) allows $500 per violation, treble for willful → $1,500. Same numbers as federal but more aggressive plaintiff bar.
Separate DNC lists
Indiana, Pennsylvania, Tennessee, Wyoming maintain their own. Subscribe + load into VICIdial's vicidial_dnc.
Operational pattern
For multi-state campaigns:
- Segment your lists by state — separate
list_idper state. - Per-state campaign overrides for time windows + recording rules.
- State-specific DNC loaded into VICIdial scoped to the state's campaign_id.
- Per-state caller ID if you have local DIDs in those states.
This is more setup work than running one global campaign, but it's how you stay compliant + how you maximize answer rates by matching local presence.
