Recording — Massachusetts Wiretap Act
Two-party consent under M.G.L. c. 272, § 99. Massachusetts's wiretap statute is one of the strictest in the country and applies criminal penalties for unauthorized recording.
Disclosure pattern:
- Beep at call start
- Spoken: "This call is being recorded"
- If caller objects → stop recording immediately
Telemarketer registration
Required for commercial telemarketing under M.G.L. c. 159C. Annual filing + bond.
Calling hours
8am-8pm Eastern (one hour tighter than federal).
Honor MA Do Not Call
Massachusetts honors the federal DNC. No separate state list, but state AG aggressively enforces.
