Texas Business and Commerce Code Ch. 305 — what TX adds to federal TCPA.

Texas regulates telemarketing under the Texas No-Call Law and Tex. Bus. & Com. Code § 305 et seq.

Key requirements

Texas DNC (the "Texas No Call List")

Separate from federal. Maintained by the Texas Public Utility Commission. Subscription required to access.

You must honor it for any commercial telephone solicitation to a Texas number.

Registration

Telemarketers calling Texas residents must register annually with the Texas Department of Licensing and Regulation. ~$200 fee. Some exemptions apply (e.g., calls to existing customers within 18 months).

Calling hours

9am-9pm Central time — slightly different from federal (federal is 8am-9pm).

Recording

One-party consent for telephone calls (Texas Penal Code § 16.02).

  • [ ] Texas DNC list subscribed + loaded into VICIdial scoped to TX campaigns
  • [ ] Annual registration with TDLR (or confirmed exemption)
  • [ ] 9am-9pm Central enforced
  • [ ] Federal DNC also honored
